The <a href="https://www.mid-day.com/mumbai/mumbai-news/article/six-years-on-thane-mact-awards-rs-25-lakh-compensation-to-accident-victims-kin-23604806" target="_blank" rel="none noopener">Motor Accidents Claims Tribunal</a> (MACT) in Maharashtra's Thane district has awarded a compensation of Rs 36.9 lakh to the family of a 52-year-old man killed in a motorcycle accident in 2017, reported news agency PTI.
Thane MACT member K P Shrikhande ordered the owner of the errant vehicle to jointly and severally pay the compensation with 9 per cent per annum interest from the date of filing the petition, reported PTI.
A copy of the order passed on November 25 was made available on Saturday.
Advocate UR Vishwakarma, appearing for the petitioners, told the tribunal that the fatal accident occurred on January 29, 2017, in <a href="https://www.mid-day.com/mumbai/mumbai-news/article/thane-mact-awards-rs-16-48-lakh-to-mumbai-motorcyclist-injured-in-2018-accident-23605179" target="_blank" rel="none noopener">Padgha</a>, where the victim, Janardan Kene, was riding his motorcycle, and another two-wheeler approaching from the opposite direction dashed into him, reported PTI.
Kene sustained fatal injuries and died the same day while undergoing treatment at a hospital.
A case was registered against the rider of the offending vehicle under various sections of the Indian Penal Code and the <a href="https://www.mid-day.com/mumbai/mumbai-crime-news/article/maharashtra-thane-court-awards-rs-27-9-lakh-compensation-to-kin-of-bus-driver-killed-in-2011-collision-23604107" target="_blank" rel="none noopener">Motor Vehicles Act</a> for rash and negligent driving. The respondent, the owner of the errant vehicle, failed to appear, and the petition proceeded ex parte.
The Thane MACT calculated the compensation based on the deceased's net monthly salary of Rs 31,392 (after tax deductions). The total loss of dependency was Rs 34.18 lakh, leading to a final total compensation of Rs 36.95 lakh to the victim's wife and four children, reported PTI.
<h2>Tribunal awards Rs 16 lakh compensation to motorcycle rider injured after being hit by car</h2>
Meanwhile, the Motor Accident Claims Tribunal (MACT) in <a href="https://www.mid-day.com/mumbai/mumbai-news/article/thane-mact-orders-msrtc-to-pay-rs-55-lakh-compensation-to-woman-injured-in-bus-accident-23602265" target="_blank" rel="none noopener">Maharashtra's</a> Thane has awarded a compensation of Rs 16.48 lakh to a motorcycle rider, who suffered grievous injuries after being hit by a car in Mumbai in 2018, reported PTI.
The verdict was passed by the tribunal presided over by its member Rupali V Mohite on November 24, reported PTI.
The petition was filed by the injured person, Sarfaraz Abutalib Shaikh, who suffered a permanent partial disability, reported PTI.
The accident occurred in the afternoon of May 5, 2018 on the Parel Bridge in Mumbai.
Shaikh, a <a href="https://www.mid-day.com/mumbai/mumbai-news/article/thane-mact-grants-rs-23-27-lakh-compensation-to-man-injured-in-highway-accident-23601623" target="_blank" rel="none noopener">DJ operator</a>/event manager who was then 38, was riding a motorcycle when a car driven rashly and negligently, came from the opposite direction, jumped the road divider, and collided head-on with his motorcycle, reported PTI.
The impact was so severe that the pillion rider fell off the bridge, while Shaikh sustained grievous injuries, including multiple fractures.
The car occupants, identified as driver Vinayak Lotan Patil (Navi Mumbai) and Dinesh Ashok Gurnani (Mumbai), failed to file a written statement, resulting in the case proceeding ex parte against them, reported PTI.
The tribunal said, "As per the evidence on record, the offending car came towards the wrong side of the road by crossing the divider and gave a dash to the motorcycle of the claimant. The pillion rider on motorcycle fell down from the bridge. This shows the rashness and negligence of the car driver."
<a href="https://www.mid-day.com/mumbai/mumbai-crime-news/article/thane-mact-awards-rs-30-lakh-compensation-to-family-of-man-killed-by-reversing-bus-23601949" target="_blank" rel="none noopener">The tribunal</a> directed the car occupants to pay Rs 16,48,960 along with interest calculated at 9 per cent per annum from the date of the petition until the amount is deposited.
